Effective July 1, 2012, after having been signed into law by Governor Mitch Daniels on March 19, 2012, Indiana's 1993 statewide Clean Indoor Air Law was repealed and replaced by a new chapter of the Indiana Code titled "Prohibition on Smoking.
" The new chapter bans smoking in all enclosed public places and workplaces in Indiana and within eight feet of an entrance thereto, except as exempted. The law exempts: (1) horse racing facilities; (2) riverboats; (3)
all indoor portions of casinos and other licensed gaming facilities; (4) cigar bars and hookah lounges; (5) private clubs; (6) retail tobacco stores; (7) bars and taverns (defined as any business with a liquor license that does not allow in persons under 21 years of age); and (8) cigar manufacturers. The law expressly allows local governments to enact more stringent smoking restrictions.
Attempts in the Indiana General Assembly to enact a ban on smoking in all workplaces in Indiana, including all bars and restaurants, have failed every year since 2007.
