Statewide smoking ban: On October 1, 2005, the Montana Clean Indoor Air Act (MCIAA) went into effect, 
banning smoking statewide in all enclosed workplaces in Montana including restaurants, though bars were exempt until October 1, 2009; the word "bar" is defined in the Act as also including taverns, night clubs, cocktail lounges, and casinos. The act exempts private residences not used as a daycare facility or healthcare facility, private motor vehicles, tobacco demonstrations in schools, designated hotel/motel smoking rooms,




 and Native American religious and cultural activities. Local governments are preempted from regulating smoking more stringently than the Act.

In 2005, the Montana legislature passed the Clean Indoor Air Act (CIAA), one of the most important public health policies in state history. Laws like the CIAA reduce heart attack rates by at least 20 percent. They also reduce lung disease, including lung cancer, as well as other debilitating and fatal illnesses, and they protect unborn children and young children from health problems.
The law requires all enclosed public places and workplaces to be smokefree and it requires businesses to prominently place smokefree signs on all public entrances.
The Montana Department of Public Health and Human Services has adopted rules.
The health benefits of the law are three-fold:
  • Patrons and workers alike are protected from the deadly health effects of secondhand smoke exposure.
  • More people who smoke will try to quit.
  • Fewer Montana youth will begin smoking.
Surveys reveal that the vast majority of Montanans support the CIAA and believe Montana workers deserve a smokefree place to work. In a recent survey, more than 90 percent of Montanans stated they will visit bars as often or more often now that the law is in place. 

Montana Marijuana DispensariesThe Montana Department of Health and Human Services has stopped issuing new medical marijuana cards, a spokesman announced on Tuesday.

The agency is complying with a strict new medical marijuana law that requires the department to stop issuing the cards on May 14, according to spokesman Jon Ebelt, reports the Associated Press.
Ebelt had previously said the department would continue issuing the cards to patients because of confusion over the law.

The first phase of a new restrictive medical marijuana law, pushed through the Montana Legislature by Republicans, went into effect May 14. It negated much of the law passed by 62 percent of state voters in 2004.
